AIGymLabs - Workouts — Terms of Service

Introduction

These Terms of Service ("Terms") are a binding legal agreement between you and LaboGymIA inc. (doing business as AIGymLabs) for the AIGymLabs - Workouts mobile app, aigymlabs.com, and related services.

By creating an account, accessing, or using the service, you confirm you have read, understood, and agree to these Terms. If you do not agree, do not use the service.

1. AIGymLabs - Workouts is not medical advice, and we are not clinicians

AIGymLabs - Workouts is a resistance-training planning and logging tool. It is not medical advice, not clinical care, and not a medical device.

• We are not doctors, physiotherapists, dietitians, or licensed clinicians, and no clinician-patient relationship is created.
• The algorithm cannot see your knee, your shoulder, your pain response, your form quality, or your local training conditions in real time.
• We do not diagnose, treat, cure, monitor, or prevent injuries, illnesses, or medical conditions.
• Exercise demonstrations are for general reference only and are not individualized medical or coaching instructions.
• You remain fully responsible for exercise selection, load, ROM, warm-up choices, and deciding when to stop any set or session.

Resistance training carries inherent risk, including acute and overuse injuries. Use judgment, and seek qualified medical advice before beginning or changing training, especially if you have pain, injury history, surgery, pregnancy, prolonged detraining, or any health condition.

2. Your account

• You must be at least 18 years old to create or use an account.
• One person, one account. Account sharing is prohibited.
• You must provide accurate information and keep it current.
• You are responsible for account security and all activity under your credentials.

Available sign-in methods (three): Apple Sign In, Google Sign In, and email/password.

You must continue using the same sign-in method originally used for your account. Using a different method can create a separate account and may prevent access to your previous training data.

If you use Apple Hide My Email, delivery of critical account notices depends on Apple relay behavior and your mailbox settings. You are responsible for keeping a working email route for security, billing, and legal notices.

Deleting the app from your device does not delete your account, stored data, or active subscription billing.

3. What we grant you

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable personal licence to install and use AIGymLabs - Workouts on devices you own or control for individual, non-commercial training use.

4. What you may not do

• Use the service unlawfully or in violation of applicable regulations.
• Reverse engineer, decompile, disassemble, or attempt source extraction except where non-waivable law permits.
• Scrape, crawl, automate, bot, or bulk-access the service without written authorization.
• Circumvent authentication, paywalls, security controls, anti-abuse systems, or rate limits.
• Resell, sublicense, or run unauthorized commercial coaching workflows on top of the service.
• Copy, extract, download, republish, or commercially reuse exercise videos, demonstrations, media assets, or programming outputs except as expressly permitted.

5. Your content

You retain ownership of your logs, notes, settings, and training-performance inputs.

You grant us only the rights needed to host, secure, sync, process, and display your data so we can operate the service and generate your program outputs.

You must not upload illegal content or content you do not have rights to share.

We do not use your personal training data to train public machine-learning models. Privacy handling is described in our Privacy Policy.

6. Premium subscriptions

AIGymLabs - Workouts includes a free tier and optional Premium subscriptions sold through Apple App Store and/or Google Play (each a "Store"). We do not directly process in-app subscription charges.

7. Availability, and things breaking

The app is designed for offline-first gym-floor use, but some functions require network access, including sign-in, purchases, account management, and cloud sync.

Features may change, pause, or be removed for legal, operational, security, or technical reasons. Outages, delays, sync conflicts, and third-party disruptions can happen.

8. Third-party stores and services

Service delivery depends in part on third parties (including app stores, identity providers, analytics, hosting, and payment systems). Their terms, availability, and technical behavior are outside our direct control and may affect your experience.

9. Our intellectual property

AIGymLabs, app software, source code, training-engine logic, text, exercise media, visual assets, and brand identifiers are protected by intellectual property laws.

Except for the limited licence in Section 3, all rights are reserved.

10. Warranties

To the maximum extent permitted by law, the service is provided “as is” and “as available,” without express, implied, or statutory warranties, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, AIGymLabs and its directors, officers, employees, contractors, and affiliates are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, and business interruption.

Where liability cannot be fully excluded, aggregate liability is limited to the greater of: (a) the amount you paid for Premium in the 12 months before the claim event, or (b) CAD $50.

12. Indemnity

You agree to indemnify and hold harmless AIGymLabs from claims, losses, liabilities, damages, and reasonable legal fees arising from your misuse of the service, breach of these Terms, or violation of third-party rights.

13. Termination

We may suspend or terminate access for legal, security, anti-abuse, or operational reasons, including violation of these Terms.

You may stop using the service at any time. To request account deletion, use /deleteaccount.

14. Governing law and disputes

These Terms are governed by the laws of Quebec and the applicable federal laws of Canada, excluding conflict-of-law rules.

You and AIGymLabs submit disputes to the competent courts in Montreal, Quebec.

There is no forced arbitration clause and no class-action waiver in these Terms. Non-waivable consumer-protection rights continue to apply.

15. Changes to these terms

We may update these Terms for legal, product, security, or operational reasons. When required, we will provide notice in-app, by email, or by publishing updated Terms with a new effective date.

Continued use after the effective date means you accept the revised Terms.

16. Everything else

• If any provision is unenforceable, remaining provisions remain in effect.
• Failure to enforce any provision is not a waiver.
• You may not assign these Terms without our prior written consent.
• These Terms and the Privacy Policy are the entire agreement for the service.
• English-language clause: where multiple language versions are published, the English version controls for users outside Canada unless mandatory local law requires otherwise.
• Version precedence for Canada vs outside Canada: in any conflict between summaries, FAQs, store listings, in-app tooltips, and these Terms, these Terms prevail; mandatory local law controls where required.
